There are some new twists and turns in the latest teacher and teen sex case. I’m sure you remember Kelsey Peterson, the teacher who ran away with her student and was caught in Mexico last week. Her student is an illegal immigrant and wasn’t allowed to return back to the States. Well, Kelsey Peterson is twenty-five and it was believed that her student was thirteen years old. Now, Kelsey Peterson’s attorney is saying that they aren’t really sure exactly how old the boy is. Since he is an illegal immigrant, they believe that his birth certificate was faked and her attorney is requesting proof of his age. According to the attorney, the boy must be older than thirteen because he shaves and has a mustache. If he is older (they are suspecting that he may be sixteen or older) Kelsey may not face statutory rape charges. Kelsey’s attorney is also suggesting that the boy was making plenty of advances towards the teacher and not the other way around.

Kelsey’s attorney, James Davis, also states that the boy went with Kelsey willingly, therefore the kidnapping charges should be dropped. The boy may be able to return to the United States, if he gets a U Visa. This type of Visa is used when illegal immigrants come back to the country to report crimes that have been committed against them.
All I can say is that Kelsey Peterson has a very resourceful defense attorney. Though, I am not sure how well his strategy is going to play out. If this is a wild goose chase and the inquisition over the birth certificate is simply a ploy to throw off the media’s perception of Kelsey, I doubt it will work. I don’t think people in general will care if the boy was twelve or fifteen when they first got together. I also don’t think that people will think that those three years should mean the difference between a kidnapping charge as well. Now, if it turns out that he is eighteen and was pretending he was thirteen because he especially loved the eighth grade that will be one thing. Somehow, I doubt that is the true scenario. I also don’t think the fact that the boy has a mustache or shaves should lessen the guilt of Kelsey Peterson is either. The only thing that is going to matter in this case is the boy’s age and if it is under the legal limit for statutory rape. It either is or it isn’t, and I don’t think there is any way that James Davis is going to be able to spin that in Kelsey’s favor.
One thing seems sure; this doesn’t seem to be a Mary Kay Letourneau and Vili Fualaau type of relationship. Mary Kay Letoruneau spent seven years in prison for her sexual relationship with her student, Vili Fualaau. However, both Mary Kay and Vili continued to profess their love for each other and continually broke the law to be with each other. They had two daughters and as soon as Mary Kay was released from prison and Vili was of legal age, they sought the court for the right to be married. They married and are still together to this day. It seems that of all of the teacher student relationships that none of them seem to be following in Mary Kay and Vili’s footsteps. These don’t seem to be cases of forbidden love but of child molestation, and because of that fact there is very little spin a defense attorney can weave to change the public’s opinion.
